Your personal information is very important to Siming Technology Co., Ltd. (hereinafter referred to as "Siming Technology").

This document (“Privacy Policy”) is intended to explain to you how Simming Technology manages personal data in accordance with the Singapore Personal Data Protection Act and other applicable legal provisions of data protection, including the EU General Data Protection Ordinance. Please read this Personal Data Policy carefully to learn how we collect, use and disclose your Personal Data.

By interacting with us, accessing our website, submitting information to us (through our website or other means), or registering our products or services, you agree that you collect, use, disclose and share your personal data to the Group's authorized service providers and related third parties in the manner specified in this Personal Data Policy.

This policy supplements, but does not replace or replace any other consent agreements you have previously provided to Siming Technology, and does not affect any rights of Siming Technology to legally collect, use or disclose your personal data. Siming Technology may update this policy from time to time to ensure that this policy is consistent with any changes in our future developments, industry trends and/or laws and regulations. Under your legal rights, you agree and accept the terms of the policy revised from time to time on our website (www.tellhowsemi.com). To avoid doubt, this Personal Data Policy forms part of the terms and conditions of your relationship with us (“Additional Terms and Conditions”) and shall be read with these additional terms and conditions.

1. Your personal information

1.1 What types of personal data do we collect?

1.2 In this Personal Data Policy, “Personal Data” means any information about an identifiable individual, whether true or not:

(a) from these information; or

(b) From information and other information that we have access to or may have access to, including information in our records, may be updated from time to time.

1.3 You may provide us with such personal information, including (depending on the nature of your interaction with us) your name, ID card, passport or other ID number, date of birth, gender, nationality, contact number, residence and/or mailing address, email address, and any other information you provide in any form with us or through other forms of interaction with you.

2. Collection of personal data

2.1 Generally speaking, Siming Technology will collect your personal information through the following methods:

(i)    When you submit a form about our products or services;

(ii) When you register or use any of our services on a website that we own or operate, or when you register as a member of the website that we own and/or operate, or use the services on such websites, or participate in any of our social media services (such as through our Wechat page);

(iii) When you communicate with our customer service and marketing specialists, including face-to-face meetings or over the phone;

(iv)   When you use our services;

(v)    When you ask us to contact you;

(vi) When our marketing representative or agent contacts and responds to you;

(vii) When you respond to our request for more personal information;

(viii) when you subscribe or request to be included in our email or other mailing list;

(ix)   When you respond to our promotions or other activities;

(x) When you participate in promotions and lucky draws at any of our shopping malls or malls;

(xi)   When you respond to our market research;

(xii) When you submit a job application to our group;

(xiii) When you enter into an agreement with us, including a purchase option, a sale and purchase agreement, a lease agreement, a license agreement or any other short-term occupation agreement or offer;

(xiv) When we receive recommendations from business partners and third parties, for example, they have recommended you;

(xv)    When you submit your personal information to us for any other reason.

2.2 You are usually anonymous when you browse our website, but see Section 5 “Using Cookies” and Section 6 “IP Address”.

2.3 If you provide us with any personal information related to a third party (such as information about your spouse, children, parents and/or employees), or, if you recommend a third party to us so that we can provide our products and/or services to that third party, by submitting such information to us, you show us that you have obtained the consent of a third party to allow you to provide us with their personal information for the following purposes.

3. How do we use personal data and to whom do we disclose it?

3.1 Our business is to understand and meet your needs and provide you with the services you need. To do this effectively, we need to collect a range of personal data about you.

3.2 Generally, Siming Technology collects, uses and discloses your personal information for the purposes listed below:

(i) Provide you with the required products or services;

(ii) Help us analyze, review, develop, manage and improve our products and services, including analyzing future customer needs;

(iii) Communicate with you and respond to your questions, requests and complaints;

(iv) Provide ongoing information that may be relevant to you and about our products and services;

(v) Handle disputes, conduct investigations and litigation;

(vi) Protect and enforce our contractual and legal rights and obligations;

(vii) Prevent, detect and investigate crimes, including fraud and money laundering, and analyze and manage other business risks;

(viii) Promote any proposed or actual business transactions involving Siming Technology (which may extend to any reorganization, merger, acquisition or sale)

(ix) Promote any proposed or actual business allocation, transfer, participation or subordinate participation in any rights and obligations related to your relationship with us

(x)     Comply with any applicable rules, laws and regulations, codes of practice or guidelines, or assist relevant authorities in law enforcement and investigation; and

(xi)   Purposes reasonably related to the above.

3.3 In addition, depending on the nature of our relationship with you, Siming Technology may collect, use and disclose your personal data for the following purposes:

3.4 If you are a supplier, potential supplier or contractor or its employees:

(i) Manage outsourcing relationships;

(ii) Conduct background checks and due diligence;

(iii) Contact you in an emergency;

(iv)    Process any payments for invoices and reimbursements, including payments for accounts payable; and

(v) Any other purpose directly related to any of the above

3.5 If you submit a job application to us as an applicant:

(i) Process your application, including pre-recruitment verification;

(ii) Provide or obtain employee recommendation letters or other recommendation letters related to background screening/review;

(iii) Collect information on whether I am suitable for the position;

(iv) Organize training and employee development plans;

(v)     Evaluate your performance;

(vi) Manage benefits and salary processing;

(vii) Provide you with tools to facilitate you or to complete your work as required;

(viii) communicate with you as required by Siming Technology to comply with its policies and procedures, including for business continuity purposes; and

      

3.6 For the purposes described above, you should ensure that all personal information submitted to us is complete, accurate, true and correct. Failure to do this may result in the inability to provide the relevant products and services you request.

3.7 If you specifically provide us with additional agreements, Siming Technology may also collect, use and disclose your personal data for the following purposes:

(i) You subscribe to our email;

(ii) Provide you with marketing and promotional information about our services, products and benefits, including offers, promotions, loyalty and reward programs;

(iii) regularly send you the latest news on products, services, offers and promotions from our business partners and/or our affiliates;

(iv) Send you relevant regular updates, information, survey requests, promotions and invitations to events for the mall you have agreed to;

(v) Manage competitions, competitions and sweepstakes, including publishing the results of competitions, competitions and sweepstakes, identifying and contacting winners, and promoting and conducting marketing activities closely related to these competitions, competitions and sweepstakes;

(vi) Send you invitations to our corporate events, feedback meetings, etc.; and

(vii) Conduct market research, evaluate owner satisfaction, and collect customer feedback to enable us to develop special offers and marketing plans.

3.8 We may also specifically notify you of other purposes for our collection, use or disclosure of your personal data for a particular product or service, or in your interaction with us. If so, we will also collect, use and disclose your personal data for these additional purposes unless we have notified you specifically.

3.9 We may also be required to collect, use or disclose your data for the “legitimate interests” defined in the Personal Data Protection Act. Such legitimate interests may include, but are not limited to, the purpose of assessment, the recovery or payment of debts owed, threats to security, discovery and prevention of fraud, information technology and cybersecurity, prevention of abuse of services and conducting other necessary corporate due diligence.

3.10 Your personal data will be protected and confidential, but in accordance with any applicable law, this personal data may be disclosed to the following parties in accordance with the relevant products or services and for the purposes described above (if applicable):

(i) Other departments or organizations within the Group, our affiliates and affiliates;

(ii) Agents, contractors, third-party service providers and expert consultants who sign up for Siming Technology to provide administrative, operational or other goods and services (such as telecommunications, IT, payment, salary, processing, training, market research, storage or archives) to Siming Technology;

(iii) Any third-party business partner that provides goods and services or sponsors competitions or other promotional programs, whether or not in partnership with Siming Technology;

(iv) Courts, courts and regulatory agencies consented or authorized by law;

(v) Any business partner, investor, intangible asset assignee or (actual or expected) tangible asset assignee to facilitate business transactions involving Siming Technology (which may extend to any restructuring, merger, acquisition or sale);

(vi) Our professional consultants, such as our auditors and attorneys;

(vii) the relevant government, statutory or regulatory authority (including stock exchanges) or law enforcement authority to comply with any laws or regulations implemented by the institution, or any order, notice, direction or judgment of any court, court, arbitration or mediation agency;

(viii) any object to which we transfer or may transfer any of our rights and obligations; and

(ix)   A third party to which you agree, especially by an individual or other party specified in the contract.

4. “DNC) regulations

4.1 If you provide us with your Singapore phone number and you agree to receive marketing or other promotional information through your Singapore phone number, Simming Technology may use this Singapore phone number from time to time to contact you (including via voice calls, text messages, faxes or other means) to send information about our products, services (including discounts and special offers) and other invitations to events, even if these phone numbers have been registered at the "No Calls" Registration Office. However, if you do not wish to contact us via your phone number, you may notify us in writing.

5. Use of Cookies

5.1 When you interact with us on our website, we will automatically receive and record information on the server log from your browser. When you visit our website, we may assign one or more cookies to your computer. A cookie is a small encrypted text document stored in the "Cookies" folder on your computer's hard drive and can be used to collect information and statistics about your visit to our website, including how you arrive at our website, the type of browser you are using, the operating system you are currently using, your IP address, and your clickstream information and timestamp (for example, which pages you view, the time you visited these pages, and the time spent on each page on our website). 8.2 Please note that if your personal data is provided to us by a third party, you should ask that third party to make a request for inquiries, complaints, access and corrections to Siming Technology on your behalf.

8.3 If consent is withdrawn from any or all of your personal data we have, Siming Technology may not be able to continue to provide you with its products or services depending on the nature of your request. Therefore, your withdrawal of your consent may violate the obligations under the agreement between you and Siming Technology, which may lead to Siming Technology's termination of the agreement. Siming Technology ensures legal rights and remedial measures to remain in this incident.

9. Data transmission

9.1 If it is necessary to share your information with our business companies and partners, we will take reasonable steps to ensure that the personal data you transmit outside your country of residence is fully protected. In addition, we will ensure that such transmissions comply with applicable data protection laws.

10.    Information retention

10.1 We may retain your personal data as long as it is for the purpose of collecting information and (1) for a maximum of 7 years in most cases; or (2) for a maximum of 10 years in respect of our activities in the EU, unless otherwise provided by applicable law or for defense purposes. If we no longer require your personal data for these purposes, we will no longer retain them.

11.    Personal Rights

11.1 Under applicable data protection laws, you have the following rights (unless the exercise of these rights is limited by applicable law – for example, due to judicial proceedings or investigations) that you may exercise these rights by contacting the relevant data protection specialist.

(i) You have the right to obtain from us a confirmation letter of whether your personal data is being processed and to request a copy of your data.

(ii) You have the right to correct your personal information. We know that this information will change frequently as the address and other personal circumstances change. We encourage you to contact us as soon as possible so that we can update any of your personal information. Incomplete or expired personal data may cause us to be unable to provide you with the products and services you requested;

(iii) In some cases, you have the right to request the deletion or restriction of the processing of your personal data;

(iv)   If we process your information based on the above legitimate interests or public interests, you may object to such processing in certain circumstances. In this case, we will cease processing of your information unless we have a compelling legal reason to continue processing, or it is necessary to continue processing for legal reasons. (v) Prevent any processing of personal data from causing unnecessary substantial damage or trouble to you or other individuals;

11.2 If you withdraw your consent to use any or all of your personal data that we have, Siming Technology may not be able to continue to provide you with its products or services depending on the nature of your request. Therefore, your withdrawal of your consent may violate the obligations under the agreement between you and Siming Technology, which may lead to Siming Technology's termination of the agreement. Siming Technology ensures legal rights and remedial measures to remain in this incident.

11.3 You shall exercise the above rights for free under applicable data protection laws. In all other cases, we may charge fees to cover the cost of verifying requests and finding, retrieving and copying of any requested material.

12. Appointment of the Data Protection Commissioner

12.1 We have appointed a Data Protection Specialist to monitor our management of your personal data in accordance with this policy and applicable Data Protection Laws. We train employees who process your personal data to respect the confidentiality of your personal data and we take violations of all applicable data protection laws very seriously.

13. Policy Review

13.1 This policy will be reviewed from time to time by us. We may also update this policy from time to time to adapt to new laws and technologies, changes in our operations and practices, and the ever-changing business environment. 13.2 If there is any inconsistency between the English version of this policy and other translations, the English version shall prevail.

14.1 This Personal Data Policy is governed by Singapore’s laws in all respects.
